国务院发布金融控股公司准入管理决定
9月13日电 据中国政府网13日消息，国务院印发关于实施金融控股公司准入管理的决定(下称《准入管理》)，自2020年11月1日起施行。《准入管理》规定，申请设立金融控股公司，实缴注册资本额不低于人民币50亿元，且不低于所直接控股金融机构注册资本总和的50%；未经中国人民银行批准，不得登记为金融控股公司，不得在公司名称中使用“金融控股”、“金融集团”等字样。

《准入管理》称，为加强对非金融企业、自然人等主体控股或者实际控制金融机构的监督管理，规范金融控股公司行为，防范系统性金融风险，对金融控股公司实施准入管理。

中华人民共和国境内的非金融企业、自然人以及经认可的法人控股或者实际控制两个或者两个以上不同类型金融机构，具有本决定规定情形的，应当向中国人民银行提出申请，经批准设立金融控股公司。

金融控股公司，是指依照《中华人民共和国公司法》和本决定设立的，控股或者实际控制两个或者两个以上不同类型金融机构，自身仅开展股权投资管理、不直接从事商业性经营活动的有限责任公司或者股份有限公司。

金融机构的类型包括：商业银行(不含村镇银行，下同)、金融租赁公司；信托公司；金融资产管理公司；证券公司、公募基金管理公司、期货公司；人身保险公司、财产保险公司、再保险公司、保险资产管理公司；国务院金融管理部门认定的其他机构。

《准入管理》明确，中国人民银行根据本决定制定设立金融控股公司条件、程序的实施细则，并组织实施监督管理，可以采取相关审慎性监督管理措施。
