How I Eventually Secured A Patent For "2 Of My Sport-Related Inventions", Using Steem Technology?

<p>How many ideas, inventions etc have stayed hidden from the rest of humanity forever?</p>
<p>Perhaps, there is already some crazy invention out there, that can have saved humanity, fixed yet unsolved problems, answer countless unanswered questions; but have stay hidden till date because the inventor is afraid of losing his only and priceless intellectual property, just because of his in ability to bring it to life or at least get some form of patent for it?</p>
<p>Patents allow for people to come open on their ideas or inventions, for the possible common good of humanity. Inventors can thus, be given legal rights or ownership to their intellectual property, by their government, for the duration of their patent; excluding and preventing others from being able to make, use, sell, offering for sale, import, replicate the patented invention, during the period that patent is own.&nbsp;</p>
<p>After the expiry of patents, however, the idea or invention becomes exploitable and reformable by others!</p>
<p>Basically, this model, involves a public domain or repository, where details of the inventions are declared, then patent examiner who issues the patent, if the invention idea is patentable and a bunch of fees, for an enforcable patent to come to life!</p>
<p><br></p>
<p>Once a patent application is started, next steps will involve a patent examiner, who will analyze and determine, based on many criteria, if your invention idea is patentable and decide upon, whether to reject or grant your patent application. If granted, payment of additional fees, will be required, leading to an issued, enforceable patent!</p>
<p><strong>This model does encourage inventors to reveal their inventions to the public but based on my opinion, is almost equally its flaw!</strong></p>

<blockquote>How about the fear of not getting your patent approved, after you have made public claims, detailing your ideas or invention?&nbsp;</blockquote>

<p>Evidently, a person who lives below 1$ a day, who is so keen on protecting his idea as it is obviously and perhaps, his only possession or property; will definitely consider all these questions mentioned above and countless more!&nbsp;</p>
<p>Imagine what <a href="https://en.wikipedia.org/wiki/Patent">wikipedia</a> says, about costs involved in maintaining patents.</p>
<blockquote><a href="https://en.wikipedia.org/wiki/Patent">The European Patent Office estimates for obtaining and maintaining their patent, for a 10-year term in 2005, was an average cost of around €32,000.</a></blockquote>
<blockquote><a href="https://en.wikipedia.org/wiki/Patent">In the United States; 2000; this cost ranged from $10,000 to $30,000 per patent. When patent litigation is involved, the fees are significantly higher. If litigation involves court settlement, costs can get to millions of dollars!</a></blockquote>
<p>Hahaha, these are costs from more than a decade ago!</p>
<p>(NB:<strong> In many nations, costs may be involved in the process of applying for a patent, let alone the additional costs for maintaining it or keep it alive!</strong>)</p>

<p>Understanding the above, makes it clear, that if inventors had to rely on conventional patents, for protection of intellectual property; many invention ideas, will stay hidden forever and this may not be doing humanity too much good.&nbsp;</p>
<p>As Trump and security agencies, endlessly look for solutions or infrastructures to curb, say <strong>ISIS</strong> for instance; the intellectual property to effect this, may already exist somewhere; in someone's head; in someone's scrap book and may have stayed for years already, thus, way hidden from the rest of humanity; because this person or persons, cannot afford the rigor, costs, maintenance and delays involved with patent application!</p>
<p><br></p>
<p>Apart from costs, that deters inventors from conventional patent application, they are other deterrents:</p>
<p>Remember too, that patents may only be governed by laws of the country, where the patent was established. So basically, <a href="https://en.wikipedia.org/wiki/Patent">the production of an item in China, for instance, that should have infringed upon a U.S patent, would not constitute a valid infringement, under US patent law, unless these items got imported into the USA.</a></p>
<p><strong>NB. Location is a factor!&nbsp;</strong></p>
<p>In most jurisdictions, third parties are able to challenge the validity of an active patent. This can also happen in a court, where the third party questions, even the patentability of an enforced patent!&nbsp;</p>
<blockquote>A court is always scary and especially to an inventor without affluence or defence!</blockquote>
<p><br></p>
<p>Like any other property right, a patent may be sold or transferred, licensed to someone else, or be forgotten and abandoned.</p>
<p><br></p>
<p>This model used in conventional patent is flawed!&nbsp;</p>
<p>Same as it encourages masses of inventors, to come out and declare their inventions as opposed to possibly keeping these, secret forever, this model is flawed in my opinion and steem technology can fix it.&nbsp;</p>

<p>If patents are modeled after publicity, then it will need a blockchain; <strong>steem blockchain</strong>!</p>
<p>If it requires a governing body, steem has amazing governors!</p>
<p>If it requires litigation, steem holds quick attorneys and a ton of witnesses!</p>
<p>If it requires a petition, steem is our voice!</p>
<p>If it requires brainstorming plus a means, to create a live and working model of your invention, steem holds supporters!</p>
<p>If it requires secrecy, steem technology is a blockchain, away from the rest of the internet out there!</p>
<p>Steem transactions are quick! You will not decades of waiting, for approval of your patent.........</p>
<p>If you are too afraid of third parties challenging your patent. No courts involved in getting your patent using steem blockchain!</p>
<p>If you want to sell your license, right or ownership to your intellectual property to a third party. Steem technology provides quick, transparent transactions.&nbsp;</p>

You will have lost your intellectual property for free, to the rest of the world! It's all good!</p>

(If steem technology isn't eventually able to render full patent service, then it can most definitely play the role of an alternative strategy for getting intellectual property rights and protection, in the form of something called: <strong>A defensive publication, or defensive disclosure;</strong> which is an intellectual property protection strategy, used to prevent third party from obtaining a patent on a product, invention, apparatus or invention idea. This strategy involves declaring publicly, <a href="https://en.wikipedia.org/wiki/Patent">an enabling description and/or diagram of the product, invention idea, item or method.</a></p>

<p>Now, I will show you how i am about to do get exclusive rights to my intellectual property, to 2 of my ideas as i am declaring it publicly upon our public <strong>STEEM BLOCKCHAIN and in the face of a myriads of steemian witnesses;</strong> for the benefit of me and the rest of humanity, <strong>FOREVER!</strong></p>

<p><strong>This 2 ideas are based on sports</strong>. Well, i modified existing sports (soccer/football and basketball), so perhaps, it isn't fully mine but i like my ideas still!</p>

<p><strong>* FaceCap Basketball</strong>:</p>
<p>Pretty simple! Basically, i am add the swag of a <strong>Face Cap</strong> to the game of <strong>Basketball</strong>.&nbsp;</p>

<p>But here; i also want to add more intricacy, technicality, stunts, props; to the game of basketball, by cutting out "the periphery of vision"; which ofcourse, is a major part of the sport.</p>
<p>Imagine how much more technicality, it will involve, if all the players in a Basketball game, were wearing a <strong>Face Cap</strong>. Well, i leave you to look at this picture first and imagine where i am headed!</p>

<p>There will be new technicalities involved, for the coaches of <strong>Face Cap Basketball</strong>.&nbsp;</p>
<p>There will also be additional <strong>SWAG</strong> and<strong> branding</strong>, which is so befitting of the Luxurious game of Basketball.</p>
<p>A <strong>Lebron James</strong>, will definitely want this! I shall stop here, on this one.</p>

If you know soccer or are a coach of soccer or football, you will instantly understand, the added technicality this will bring to the game. It will be fun and i tell you, it will be new and it will get into the Olympics and will create new soccer coaching jobs!</p>

awww thank you. yes, i just playfully imagine things without barriers and kinda leave it open for everyone to tap from. i believe @ned and @dantheman have larger visions as to what the blockchain can accomplish in the future. being decentralized, thus uneraseable plus dynamic steemians, who innovate incessantly, so as to mine steem with their mind is a perfect cycle; that can make impossible possible. as for the patent stuff and a judge, at the very least, on the blockchain there is always going to be indestructible evidence, thus, if a third party goes gaga and tries to get rid all physical evidence of a patent as well as evidence of it on centralized servers, then steem blockchain may dissappoint them. Judge will become a steemian, rule the case invalid and his verdict to 3rd party, will be become a steemian or appologize to terry and repent. i am terry. i have another amazing post coming up today, hope you will see it too. it will always contain a measure of humor!

**I am reading this post 8 months later**

You shared some ideas on my recent post @buterdaniel concerning 

1. making a butt longer and thicker for someone who can't quit smoking. 

2. You gave the second idea about building an ads Empire. 

**Your ideas are fantastic.**

Now how do you protect them? 

You also explored the ideas of parenting your ideas and you gave the merit but left out the demerits. 

What could be the possibles disadvantages of putting your product out here for everyone to see. Can we explore some of them :

1. In law there's something known as the statutory patentee. That is, the person who's registers the idea first or gets a trademark for it regardless of whether he is the original inventor or not . This looks ugly and may occasion serious injustice. I will still enumerate hereunder how a non inventor can get protection of the law against the original inventor. 

2. Under Common law, any idea a worker invents using his masters resources  BELONGS TO THE MASTER. 

3. NOT EVERYONE ON THE BLOCKCHAIN IS HONEST. 

4. Someone on the blockchain may steal your idea and sell it to a person who's not on the blockchain. This person may in turn quickly get legal backing for such an idea. 

The Steem patenting you canvassed is amazing and it saves costs and time and makes ideas easier to develop Buy close consideration may reveal that the law only supports those who register their products or ideas first. This is unfair. BUT ITS STILL THE LAW. 

Thankfully, you mentioned on my post that **NO IDEA IS COMPLETELY BAD**. You always try to find the good side in it. Now here's my proposal for the reform of your Steemit patenting:

What if a bill in passed internationally to make laws regulating cryptocurrency and Steem. Such laws may include protection for people's ideas on Steem and even Steem transactions. Then member states such as in the CISG can domesticate such laws. By this you will also have solved the jurisdictional problem of territorial limitation of IP  property laws. 

 In this connection, your idea of Steemit having a lot of evidence to adduce in event of injury may play a huge role. I will explain. 

The Law may provide for requirements for registering a patent here on Steem with an added proviso that 
> anyone who uses such a patent or goes to register it will be void and of no legal consequence.

We've settled that problem. I've said enough but I wound love to hear your further thoughts on this.

I will come back to read this. The truth is i hardly have 5 mins of time a day. I have not slept in like a year but i will come back here when i am all settled. In the post, i was merely proposing using my mind playfully additional use for steem. I don't know how it will work though as even steem is open source and i tell you. i have had many ideas here with contacts from devs and you will easily know that they can pick it away from you. Steemgigs was soughted after alot. Within days, someone asked if i bought the domain steemgigs, i said no because ofcourse someone has bought it. This a big things not discussed in a comment. Overall, the community helps matters and many on steemit dont know of this core and just go on with ideas, that is already known and has followers and the community itself comes to handle matters. Many just jump at projects. I for one dont jump queues.

Deep down, my mindset has been very giant, what i mean is, i am usually on the high road. I simply make my vision very broad, very very and try to make sure the idea is not in existence or give a very special twist to what exists. Overall, it is more testimonial to my type of being to come up with something that has never existed. I am thinking billions everytimes, history. So while people even the world look for millions in traffic, i am targeting the world and removing barriers. #untalented looks small for instance, look small but i know where it is headed, where it can head and only i know that spanlessness cos i know what i have conceived of. I have special gifts too and one is in a very rare knowlegde even among the intellects of the world and it is in understand real life and humans, "no books" involved. I am an illiterate basically. So i create a vision, that only i can see then i can leave the idea out there because in reality, i dont know law but understanding life, simple concepts and logic, i know nothing is protectible. Laws regardless of how good they are can't cover all scenarios cos life is something else. you will know life to a great extent and you will grasp. Let all the law makers do life in naija and the law books will adjust. 
e.g youtube will keep stopping me from monetizing videos of me because it simple picked a song in the background which i can very much counter if i had as much power as them. Many things are subjective, so i simply cant see many things and stay up in another place, either taking the very hard route or not doing less. There are a ton of ideas in the world, a ton and the world will never tap into these ever, becase you really cant go do live in naija that tough life and if you do it, then you may not make facebooklet. I have no beefs for anyone, i just say the real raw truth. In naija alot there are myriads of ideas. on steemit, i simply just watch cos i do know naijans perhaps more than they know themselves. i have been in many of these brothers journey and you may not know but there are testimonies to what i say. Naijans for instance, have everything it takes, everything but it depends much on how you process things. Let me give you posts to read, you will grasp better.

Overall nations are locations to me. I just mention naija cos its a location with certain conditions that can turn you into greatness but you will the strongest level of stubborn genes to scale through a ton of things to end up extremely loving and really great. Great is not exactly secular here. An agbero can be great. Mentality, foresight, vision span, life, choices etc takes you there better. Again there is a difference between a may weather and a mohammed ali. Even the so-called court will know when case arise and they will pave, for he walked into the room and the room halted cos his presence filled it. As for using steem to protect idea, you can push it through since you know law or we can work on it when i am settled. I just understand underlying concepts but those are everything.

I remember coming into this platform and the first thing i was told was the, i should not save my greatest content for later, i should make them now even as a minnow, or redfish preferably. 

Terry, you made very insightful ideas here in this post, and i wont over flog what @buterdaniel has said regarding the patent right. The truth is, the steeem blockchain is structured that this ideas when posted here becomes yours and yours alone. 

However, the need for it being copyrighted, is for the unscrupulous few who takes them to the other platform they belong to and make it their establishment.  I have even seen some ideas in other platform being shifted to the steem blockchain and the becomes the property of thr bringer to the community.

You have a great mind Terry, you do. What is missing is just the little refining, shaping and moulding of it, to make it a palpable empire. I am really mused by what you do.
