Nevada is moving forward with implementing their own legalization market, that includes using a licensing scheme that gives permission <b>only to a few</b> of those who might be interested in getting involved in the business. 

## And recently, some cannabis businesses from the state have sued over allegations that the <b>licensing round</b> wasn't transparent enough and that it was allegedly ripe [for corruption](https://mjbizdaily.com/nevada-sued-lack-transparency-adult-use-marijuana-licensing/).  

<center> </center> This isn't the first lawsuit, there are several that have been filed against the state since at least 60+ adult retail store licenses had been handed out since December. It's alleged that the names of those license winners wasn't disclosed and that the scoring criteria of how they determined who should be able to obtain a license <b>wasn't transparent</b>.

Rather than allow the people of Nevada to decide for themselves, the state wants to choose who might be <b>the most suitable candidate to meet the cannabis needs of the community</b>, without sharing their criteria process. 

The option to become involved in this market shouldn't be a decision that rests with a panel, but should be a free choice that anyone should be able to make regardless of their connections in government or their history in the industry etc. Every individual should be given a fair opportunity to compete and that means that the state shouldn't stand in their way if they attempt to do so.

## Allegations of widespread corruption have plagued the legalization process in various states and countries, [with numerous reports suggesting](https://www.theadvocate.com/baton_rouge/news/politics/legislature/article_68da8954-3e83-5c5f-9b2a-c039e9faab41.html) that companies and government officials are allegedly [scurrying to establish backdoor deals](https://centerpostdispatch.com/article/california-officials-face-charges-in-cannabis-corruption-schemes).

<center></center>This is the same situation that has been happening in a myriad of jurisdictions that have moved forward with legalization; the state only wants to give out so many licenses because they have the magical foresight to know how many dispensaries <b>it's going to take</b>. Never mind that the state hasn't demonstrated themselves to be wise enough to accomplish a simple task like balancing a budget, or maintaining decent roads, surely we can trust them to know who or how many dispensaries we might need, right? 

Occupational licensing schemes have been challenged for those rules that don't just pertain to the cannabis industry, these schemes arguably only work to lower competition, fuel the foundation for monopolies, and make lots of money for the state. The rules aren't about offering protection or better services, because we'd likely have better services if the coercion scheme being promoted *wasn't involved in the market*.
