Not really, it's mostly determined by who has more money.  A company like Google or Facebook can bleed most anyone dry as they can't sustain the expenses or manpower needed to keep it going.

When there are equal finances on each side, then there may be some skill involved.  But for most, you don't stand a chance unless it's so clear as day that even a high school student can win the case.

I beat the Aussie government twice in the High Court, once with no budget at all! 
Also this case IS so clear a High School student could win it!
